1. Acceptance of These Terms
These Terms and Conditions of Use (“Terms”) govern your access to and use of thetoxfranchisinggroup.com (the “Site”), operated by The Tox Franchising Group LLC (“The Tox,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.
2. Informational Purposes Only; No Franchise Offer
The Site and the information it contains are provided for general informational purposes only. Nothing on the Site constitutes an offer to sell, or the solicitation of an offer to buy, a franchise. A franchise offer can be made only through the delivery of a Franchise Disclosure Document (“FDD”) in compliance with the FTC Franchise Rule and applicable state franchise laws.
Certain states require that a franchisor register its FDD with the state before offering or selling franchises in that state. The communications on this Site are not directed to residents of any such state by us. We will not offer or sell franchises in any registration state unless and until we have registered the FDD (or qualified for an applicable exemption) and delivered the FDD to the prospective franchisee in compliance with applicable law.
3. No Financial Performance Representations
Except for information contained in Item 19 of our FDD, we do not make any representations about a franchisee’s future financial performance or the past financial performance of company-owned or franchised outlets. The Tox provides non-medical wellness and body sculpting services. Content on the Site is not medical advice, is not a substitute for professional medical advice, diagnosis, or treatment, and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Individual experiences vary and results are not guaranteed.
5. Intellectual Property
The Site and all of its content — including the THE TOX name and logos, THE TOX TECHNIQUE, text, graphics, photographs, video, page layouts, and software — are owned by or licensed to The Tox Franchising Group LLC and are protected by trademark, copyright, and other intellectual property laws. You may not copy, reproduce, republish, distribute, display, or create derivative works from any portion of the Site without our prior written consent. Nothing on the Site grants any license or right to use any trademark displayed on the Site.
6. Permitted Use
You may use the Site only for lawful purposes. You agree not to: (a) use the Site in any way that violates applicable law or regulation; (b) scrape, harvest, or collect information from the Site by automated means; (c) interfere with the operation or security of the Site; (d) impersonate any person or misrepresent your affiliation with any person or entity, including in franchise inquiry submissions; or (e) use the Site to transmit any advertising or promotional material without our consent.
7. Franchise Inquiry Submissions; Consent to Be Contacted
If you submit an inquiry through the Site, you represent that all information you provide (including your available capital for investment) is truthful, accurate, and complete. By submitting your contact information, you consent to being contacted by The Tox and its representatives about franchise opportunities by phone, email, or text message at the contact information you provide. Consent to receive marketing communications is not a condition of any purchase. Message and data rates may apply to text messages; reply STOP to opt out.
8. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and share information.
9. Third-Party Websites and Services
The Site may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party website or service, and a link does not imply our endorsement.
10. Disclaimer of Warranties

IN NO EVENT WILL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or the Site shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to personal jurisdiction and venue there. This Section governs use of the Site only and does not supersede any dispute resolution provisions contained in a Franchise Agreement or FDD.
14. Changes to These Terms
We may revise these Terms at any time by posting an updated version on the Site with a new “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
15. Severability; Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding use of the Site.
